Abstract

Expropriation or, more precisely, forced purchase of lands and properties of individuals by the government in line with the implementation of government duties and programs, is accepted in our law. However, the government must meet conditions to achieve this goal. One of the types of immovable property that the government needs to acquire through compulsory purchase is waqf lands. The basic principle in waqf properties is the prohibition of buying and selling these properties. However, Iran's legislator has allowed the purchase of these properties for the implementation of public programs by complying with conditions in addition to the general conditions of compulsory purchase. This view of the legislator is compatible with jurisprudence.
