Abstract

The study of women's legal system in Europe requires the examination of various legal texts regarding the dignity of women and especially the principle of her equality with men, which is recognized by international documents as well as European regional documents. Why has the European Parliament played an important role in advancing women's rights in Europe by approving documents such as the European Convention on Human Rights, whose members are committed to include the principle of men and women in their constitutions and internal laws. A cross-sectional study from before the European system makes our understanding of women's rights and its positive developments more complete. The comparison of the aforementioned system with Islam shows us that only both systems recognize the equality of men and women, and as far as women's social, civil, political and economic rights and privileges are concerned, Islamic law shows that the analysis of acceptance And advanced. Is. And following social and feminist developments with the slogan of equal rights of men and women and elimination of discrimination between them in the last few decades in western countries, laws were passed that were expected to provide economic rights in the family. But the change and development of these laws continuously show that these laws still respond to the real needs of women. For centuries, Islamic jurisprudence has considered women to be independent in owning and occupying their acquired property and obliges the husband to approve the wife's needs by observing moral principles.
